Terms of Service

Welcome to Fabtech Consultant. By accessing our website (fabtechconsultant.com) or contracting our civil and structural steel engineering, detailing, BIM modeling, and estimation services, you agree to be bound by the following Terms of Service ("Terms").

1. Scope of Engineering Services

Fabtech Consultant provides professional structural steel detailing, rebar detailing, PEB & light gauge steel design, BIM coordination, and pre-bid quantity estimation take-offs. Deliverables typically include 3D Tekla structures models, 2D fabrication shop drawings, erection anchor bolt plans, bill of materials (BOM), and NC/DSTV files tailored to client shop specifications.

2. Project Engagement & Design Standards

All detailing services are executed strictly in adherence to architectural/structural contract drawings, AISC (American Institute of Steel Construction), NISD, OSHA, CISC, and project-specific specifications provided by the client. Any modifications, discrepancies, or missing dimensions identified during modeling are formally resolved via written RFIs (Requests for Information).

3. Intellectual Property & Deliverable Ownership

• Client Ownership: Upon receipt of full contractual payment, all custom fabrication drawings, CNC outputs, and project-specific 3D models generated for the project become the property of the client.
• Proprietary Tooling: Fabtech Consultant retains ownership of its proprietary custom detailing plugins, custom scripts, internal workflows, and estimation algorithms.
• Confidentiality: Both parties agree to protect proprietary drawings, shop standards, pricing schedules, and project data under mutual confidentiality.

4. Client Review & Approval Process

Prior to steel fabrication or shop cutting, approval drawings (E-sheets, advance bill of materials, and connection details) must be reviewed and approved by the Client's Engineer of Record (EOR) or designated General Contractor. Fabtech Consultant is not liable for shop fabrication errors resulting from unauthorized deviations from approved drawing packages.

5. Revisions & Scope Changes

Drawing revisions arising directly from Engineer of Record design updates, structural addenda, architectural revisions, or client scope changes issued after project baseline release will be evaluated and quoted as standard contract change orders.

6. Limitation of Liability

To the maximum extent permitted by law, Fabtech Consultant’s liability for any claims arising out of engineering or detailing services shall be limited to the total fees paid by the client for the specific detailing scope in question. We are not liable for indirect, consequential, or delay damages.

7. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
